Conditions regarding using the website

1. These terms and conditions of sale shall not be construed against the party preparing them, but shall be construed as if all parties jointly prepared these terms and conditions of sale and any uncertainty or ambiguity shall not be interpreted against any one party. No terms and conditions other than the terms and conditions contained herein shall be binding upon Emirates Auction unless accepted by it in writing, signed by its Managing Director. All terms and conditions contained in any prior oral or written communication, including, without limitation, Bidder's offers, which are different from or in addition to the terms and conditions herein are hereby rejected and shall not be binding on Emirates Auction, whether or not they would materially alter this document, and Emirates Auction hereby objects thereto. Bidders will be deemed to have assented to all terms and conditions contained herein if any part of the goods and/or services described herein are shipped or an invoice is presented in connection with the said goods and/or services.
2. Each person who wishes to participate in the auction must pay an AED 5,000 security deposit. This will be refunded three (21) working days after the auction if no purchase is made.
3. Each person who wishes to participate in the auction will be given a username and a password to enable them to login in to the auction website.
4. Participants may bid by raising the bid in the relevant online section. This increases the bid at the minimum increment as shown on screen.
5. The winner of each bid undertakes to pay the value of the licence plate by secure online credit card payment or by cheque to the Abu Dhabi Police Privatisation of Distinguished Numbers Department. This must be done within three business days from the end of the auction on the said licence number.
6. The security deposit will be confiscated if the bidder infringes the rules and regulations of the auction.
7. Bidders are entitled to own an unlimited number of Distinguished Numbers.
8. Any person who purchases a Distinguished Number will be given a permanent Ownership Certificate.
9. All vehicles that the Distinguished Numbers may be intended for are subject to the federal regulations of the Traffic & Transportation Law and its implementing decrees.
10. A fee of AED 500 is levied when issuing a replacement for a lost or damaged certificate.
11. A fee of AED 500 is levied when ownership of a Distinguished Number is transferred from one person to another.
12. All trademarks, trade names, service marks, service names, product names, logos and images used on this site belong to their respective owners.
13. This document constitutes the entire, complete, and exclusive Registration Agreement between the parties with respect to the subject matter hereof and contains part of the agreements and conditions of sale; no course of dealing or usage of the trade shall be applicable unless expressly incorporated herein. The terms and conditions contained herein may not be added to, modified, superseded or otherwise altered except by a written modification signed by Emirates Auction's Managing Director. All transactions shall be governed solely by the terms and conditions contained herein.
14. While using the Emirates Auction website, you will not:
    • Violate any laws, third party rights, or our policies
    • Attempt to use the website if you are not able to form legally binding contracts, are under the age of 18, or are temporarily or indefinitely suspended from our website
    • Fail to deliver payment for items purchased by you
    • Circumvent or manipulate our fee structure, the billing or auction process
    • Post false, inaccurate, misleading, defamatory, or libelous content
    • Transfer your Emirates Auction account and/or User ID to another party without our consent
    • Distribute or post spam, chain letters, or pyramid schemes
    • Send emails with forged headers for Emirates Auction
15. Without limiting other remedies, we may limit, suspend, or terminate our service and user accounts, prohibit access to our website, delay or remove hosted content, and take technical and legal steps to keep users off the website if we think that they are creating problems, possible legal liabilities, or acting inconsistently with the letter or spirit of our policies. We also reserve the right to cancel unconfirmed accounts or accounts that have been inactive for a long time.
16. We may choose to temporarily change the fees for our services for promotional events or new services, and such changes are effective when we post the temporary promotional event or new service on the website.
17. The website may contain robot exclusion headers. You agree that you will not use any robot, spider, scraper or other automated means to access the website for any purpose without our express written permission.
18. Additionally, you agree that you will not:
    • Take any action that imposes or may impose (in our sole discretion) an unreasonable or disproportionately large load on our infrastructure.
    • Interfere or attempt to interfere with the proper working of the website or any activities conducted on the website.
    • Bypass other measures we may use to prevent or restrict access to the website.

Contents of the website

1. Warranty and Liability
   Emirates Auction warrants that the number plates will at the time of auction correspond to the description given by Abu Dhabi Police Privatisation Department. All other warranties, conditions or terms relating to fitness for purpose, merchantability or condition of the number plates, whether implied by Statute or otherwise are excluded and the Bidder is satisfied as to the suitability of the number plates for the Bidder's purpose. It is highly recommended that an evaluation of the chosen number plate(s) is carried out to ensure that it meets your functional requirements prior to making a bid.
2. Refund/Return policy
   Bids made by registered bidders are binding. Should a winning bidder fail to settle his dues within the specified time/date, all monies paid by him/her will be confiscated by the Abu Dhabi Police Privatisation Department. All distinguished number plates are offered and auctioned on basis of no refund or return.
3. Complaints
   If you have a complaint about our service or any goods or services then please contact us immediately at complaints@emiratesauction.ae. You will be contacted as soon as possible, and at least within 24 hours of our hearing from you. We aim to provide a resolution within 5 working days. All complaints will be dealt with in a fair and confidential manner.
4. Consumer data privacy policy
   All collected data is confidential. For each anonymous visitor to our website, our webserver automatically recognizes only the consumer's domain name, but not the visitor's e-mail address. We also collect aggregate information on what pages visitors access or visit, information volunteered by the visitors, such as survey information and/or site registrations.
